This Legal page contains three documents:
1) Website & Services Terms (Terms of Service) – governs use of pcrepair.us and the Services we provide
2) Privacy Policy – explains how we collect, use, and share information
3) Remote Support Client Terms – governs any remote support client/tools used to deliver Services (where applicable)
If there’s a conflict: the Terms of Service control for the Website and Services; the Remote Support Client Terms control only for the Remote Support Client and related materials; the Privacy Policy controls for data handling.
------------------------------------------------------------
1) WEBSITE & SERVICES TERMS (TERMS OF SERVICE)
------------------------------------------------------------
These Website & Services Terms (“Terms”) govern your access to and use of pcrepair.us (the “Website”) and any services, subscriptions, purchases, support, client portals, or related offerings we provide (collectively, the “Services”).
1. Company Information
PCRepair.us LLC (“PCRepair.us,” “we,” “us,” “our”).
Operating location: Pennsylvania, United States.
2. Acceptance of Terms
By accessing the Website, creating an account, requesting Services, purchasing, or subscribing, you agree to these Terms. If you do not agree, do not use the Website or Services.
3. Eligibility
You must be able to form a binding contract to use the Services. If you use Services on behalf of a company or other entity, you represent you have authority to bind that entity.
4. Accounts and Security
If you create an account (for example, a WooCommerce account), you agree to provide accurate information and keep your login credentials secure. You are responsible for activity under your account.
5. Services; No Guaranteed Outcomes
We provide IT-related services (for example, remote troubleshooting, diagnostics, configuration, security assistance, and related support). Results can vary due to hardware condition, software state, third-party systems, prior changes, and other factors outside our control. We do not guarantee specific outcomes unless expressly stated in a written agreement signed by us.
6. Purchases, Pricing, and Availability
Prices, descriptions, and availability may change without notice. We may correct errors (including pricing errors) and may refuse or cancel orders where permitted by law. If we cancel an order after payment, we will refund the canceled amount.
7. Subscriptions and Recurring Plans
If you purchase a subscription or recurring service plan (“Subscription”):
Automatic renewal and authorization. Your Subscription renews automatically at the end of each billing period unless canceled. By purchasing a Subscription, you authorize PCRepair.us (and our payment processor) to charge your selected payment method on a recurring basis until you cancel.
Billing timing. Subscription fees are generally billed in advance at the start of each billing period unless otherwise stated at checkout, on your invoice, or in a written agreement. Unless required by law or explicitly stated at checkout, subscription charges are non-refundable once a billing period begins.
How to cancel. You may cancel your Subscription (a) through your account portal (if available for your plan), or (b) by contacting us by phone or email via pcrepair.us/contact/. We will process cancellation requests as soon as reasonably practical.
Cancellation effect; no prorated refunds. Cancellation stops future renewals. Unless otherwise stated at checkout or required by law, cancellation does not result in a refund or credit for any remaining time in the current billing period, and we do not provide prorated refunds for partial periods or unused Services. You will generally retain access to Subscription Services through the end of the current paid billing period.
To avoid renewal charges. To avoid being charged for the next billing period, you must cancel before the renewal is processed.
Failed payments; suspension. If a recurring payment fails or becomes overdue, we may retry the payment method and/or suspend Services until payment is successfully processed. You are responsible for keeping payment information current.
8. Payments, Invoices, and Late Charges
You agree to pay all charges and applicable taxes.
If you are invoiced, payment is due per the invoice terms. Past-due balances may accrue a late charge equal to the lesser of 1.5% per month (18% annually) or the maximum permitted by law, on amounts more than 30 days past due. We may suspend or terminate Services for nonpayment.
9. Returns and Refunds
Refund/return eligibility (if any) is described at checkout, on the applicable product/service page, or in a written agreement. Unless otherwise stated:
Serial keys / digital goods. Because license keys, serial keys, and other digital entitlements may be assigned or delivered upon purchase, these purchases are generally non-refundable once assigned/delivered, except where a refund is explicitly stated in the product description or required by law.
Services. Digital services, remote support time, and other service work are generally non-refundable once delivered/performed, except where required by law.
Billing errors. If you believe you were billed in error, contact us promptly (and ideally within 14 days of the charge/invoice date) so we can review and correct if appropriate.
Canceled orders by us. If we cancel an order after payment, we will refund the canceled order amount.
Discretionary exceptions. We may, at our sole discretion, issue a refund or credit in exceptional circumstances. Any such exception does not create an obligation to provide future refunds or credits in similar situations.
10. Payment Disputes and Chargebacks
If you initiate a chargeback or payment dispute without first contacting us to attempt resolution, we may suspend Services during the dispute. If a dispute is resolved in your favor, we will comply with the payment processor’s decision. If resolved in our favor, you remain responsible for any outstanding balances and any fees imposed by the payment processor.
11. Remote Support Authorization and Consent
Some Services require remote access to your device(s). By requesting or using remote support Services, you authorize us to use remote support methods reasonably necessary to diagnose and resolve issues.
You represent and warrant that you own the device(s) or have authorized permission to request remote support on them, and that you are authorized to provide credentials needed for the requested work.
During remote support we may, as reasonably needed to perform requested work:
- view your screen and system settings
- access logs and files relevant to the issue
- install, remove, or configure software
- apply updates, security settings, or configuration changes
You can revoke consent by ending the session and/or contacting us.
12. Backups and Data Responsibility
You are responsible for maintaining current backups of important data. Troubleshooting may involve changes that can affect software, settings, or data. While we take reasonable care, data loss can occur due to existing device conditions, hardware failure, malware, encryption, storage issues, or third-party software behavior.
13. Third-Party Tools and Services
We may use or rely on third-party tools and services (for example: hosting providers, payment processors, remote support platforms, security tools, email providers, and analytics). Third-party services are subject to their own terms and policies. We are not responsible for third-party outages or interruptions beyond our control.
14. Coordination With Other IT Providers / Uncoordinated Changes
If third parties (including other IT providers, employees, vendors, or friends/family) make changes without coordinating with us, outcomes may be affected. In those situations:
- additional troubleshooting time may be required (billable where applicable)
- we may decline to continue work on issues caused by uncoordinated changes
- we cannot guarantee compatibility or stability for systems altered by others without notice
15. Acceptable Use
You agree not to misuse the Website or Services. You will not:
- access systems, accounts, or data you do not have permission to access
- interfere with or disrupt the Website, our tools, or our networks
- upload malware or use the Services to harm others or violate applicable law
We may suspend or terminate access for misuse.
16. Intellectual Property
The Website, content, branding, logos, and materials we provide are owned by PCRepair.us LLC or our licensors and are protected by applicable intellectual property laws. You receive no ownership rights by using the Website or Services.
17. Disclaimers
THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee the Website will be uninterrupted, error-free, secure, or free of harmful components. We do not guarantee that troubleshooting will resolve any particular issue.
Some jurisdictions do not allow certain disclaimers; in that case, disclaimers apply to the maximum extent permitted.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PCREPAIR.US LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE OR SERVICES WILL NOT EXCEED (A) THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM OR (B) USD $100, WHICHEVER IS GREATER.
Nothing in these Terms limits liability to the extent it cannot be limited under applicable law.
19. Indemnification
You agree to indemnify and hold harmless PCRepair.us LLC and its owners, affiliates, officers, employees, and agents from and against claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Website or Services, (b) your violation of these Terms, or (c) your violation of any third party’s rights.
20. Termination
We may refuse service, suspend access, or terminate Services at our discretion, including for nonpayment, misuse, or conduct that materially interferes with our ability to provide Services.
You may stop using the Services at any time. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, and dispute terms) will survive.
21. Changes to These Terms
We may update these Terms by posting an updated version on the Website and updating the “Last updated” date. Continued use after changes become effective means you accept the updated Terms.
22. Governing Law and Venue
These Terms are governed by the laws of Pennsylvania, United States, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms, the Website, or the Services will be brought in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
